The End of Free Data Flows? The WTO's Digital Tariff Moratorium Lapses at a Fragile Moment for Global Trade
 A 28-Year-Old Truce Runs Out Since 1998, members of the World Trade Organization have observed a simple rule: no customs duties on "electronic transmissions" crossing borders. Adopted at the WTO's Second Ministerial Conference as part of the Declaration on Global Electronic Commerce, the moratorium was meant to be temporary, but it was renewed at every ministerial meeting for over two decades, even as opposition from some developing countries grew. That streak ended in March 2026. At the 14th Ministerial Conference in Yaound&eacute;, Cameroon, a draft deal to extend the moratorium to 2030 won broad support but was blocked by Brazil and Turkey, and it formally lapsed on 30 March 2026. WTO Director-General Ngozi Okonjo-Iweala noted the moratorium has lapsed once before, in 2001, and was later restored, and she has voiced hope members can revive it in Geneva before governments actually start collecting new duties.
What Exactly Gets Delivered "Electronically"? The moratorium's scope has never been formally defined, which is itself a point of dispute, but in practice it has covered any product or service sent digitally rather than on a physical medium. That includes software downloads and updates, e-books, digital music and film streaming, video games, cloud computing and storage services, online news subscriptions, digital design and engineering files, and the cross-border data flows underpinning everything from banking to semiconductor supply chains. A film once shipped as a DVD or an album sold on a CD now typically arrives as a stream; those transactions have, for 28 years, moved without the customs duties that would apply to their physical equivalents.
A Lapse Arriving Amid Rising Protectionism The timing matters. The moratorium's expiration lands as global trade is already under strain from tariff escalation, export controls, and geopolitical rivalry among major economies. Layering new, uncoordinated digital duties onto that environment risks compounding uncertainty rather than simply redistributing revenue. Even without an immediate wave of tariffs, businesses now face the possibility that any WTO member could legally impose them, which analysts say introduces compliance costs and unpredictability into digital trade regardless of whether duties are actually applied. Research cited by industry groups estimates the world has forfeited roughly $159 billion in trade annually for every year a fuller digital trade agreement remains stalled, and OECD analysis suggests new tariffs on digital inputs like cloud services would raise costs, reduce trade flows, and hit small businesses hardest. Some members, including the United States, are now pursuing plurilateral commitments outside the WTO framework &mdash; a sign the multilateral consensus approach is fraying.
Who Wins, Who Loses, and Where Disputes May Emerge The stakeholder picture is uneven. Governments in developing and least-developed countries, led by voices such as India and South Africa, have long argued the moratorium costs them customs revenue and limits policy space to nurture domestic digital industries, since developed economies dominate digital exports. Large technology and streaming companies, along with the US, EU, Canada, and Japan, prize the predictability the moratorium provided. Consumers could eventually face higher prices for streamed content, software, and cloud services if duties spread, while small and medium-sized exporters &mdash; which rely on low-friction digital channels to reach foreign customers &mdash; are seen as most exposed to added costs and red tape. Without a multilateral rule, the likely near-term outcome is fragmentation: a patchwork of bilateral and plurilateral pacts, unilateral tariff decisions by individual governments, and a higher risk of disputes as countries test the boundaries of existing trade agreements that already contain their own digital-duty-free commitments.
A Narrow Window to Restore Certainty The moratorium's lapse does not mean tariffs on streaming or software have suddenly appeared everywhere; it means the legal shield preventing them is gone, and what happens next is genuinely open. WTO talks are expected to continue in Geneva, and officials on multiple sides have signaled interest in restoring the practice, whether multilaterally or through narrower coalitions. What is clear is that digital trade has outgrown a rule improvised in 1998 for a much smaller internet economy, and how governments fill this gap &mdash; through renewed multilateral consensus, competing plurilateral deals, or a slow drift toward unilateral digital tariffs &mdash; will shape the cost and openness of cross-border digital commerce for years to come.

The WTO's Broken Appeal: Appellate Body Paralysis and the Crisis of Trade Dispute Settlement
 How WTO Dispute Settlement Works The WTO polices global trade rules among 166 members. When a member believes another has broken those rules, it can bring a case through the WTO's dispute settlement system &mdash; historically one of international law's strongest enforcement tools, since rulings became binding unless every member, including the winner, voted to block them.
Cases move in two stages:
Panels &mdash; three independent experts hear the dispute and issue a report. Appellate Body &mdash; a standing seven-judge tribunal (sitting in threes) reviews appeals on legal points. Once adopted, a report obliges the loser to comply, or the winner can seek authorization to retaliate.
 What Is "Appellate Body Paralysis"? Judges are appointed by consensus of the full membership for four-year terms. Since 2016, the United States has blocked new appointments, arguing the Body exceeded its mandate &mdash; issuing advisory opinions on moot points, missing deadlines, and treating past rulings as binding precedent. The objections predate Trump and continued under Biden and beyond.
By December 2019, membership fell below the minimum of three judges needed to hear any appeal, and the Body has been unable to function since. By late 2025, the US had vetoed restarting the selection process roughly 90 times, despite a proposal backed by around 130 members.
Consequence: Any losing party can file an appeal that can never be heard &mdash; appealing "into the void." This suspends adoption of the panel report indefinitely, so the loser owes no binding obligation to comply, and the winner cannot get authorization to retaliate. Since 2019, dozens of reports have been appealed into this limbo, and average new disputes filed per year have roughly halved versus the pre-crisis decade.
Two Real-World Examples
 US Steel and Aluminium Tariffs: Panels found the 2018 US tariffs on steel and aluminium, justified on "national security" grounds, breached WTO rules. Washington appealed into the void, so the reports were never adopted &mdash; leaving the US with no binding obligation to remove the tariffs and complainants with no legal path to authorized retaliation.
EU&ndash;China Patent Dispute: In a fight over Chinese courts issuing "anti-suit injunctions" against European patent holders, the EU and China agreed in 2023 to route any appeal through the Multi-Party Interim Appeal Arbitration Arrangement (MPIA) instead of the defunct Appellate Body. It shows binding two-stage review can survive &mdash; but only when both sides voluntarily opt in.
Alternatives Countries Are Using
 MPIA: A voluntary bloc (roughly 55&ndash;60 members, including the EU, China, Canada, Japan, Brazil) using Article 25 arbitration to mimic the old appeal stage, with a standing pool of 10 arbitrators. Pros: keeps a binding, two-stage process alive. Cons: the US and several major economies stay outside it, so it can't help when a non-member is involved or unwilling. Ad hoc Article 25 arbitration: The same DSU clause the MPIA relies on, usable case-by-case without joining. Pros: flexible. Cons: needs both sides' consent each time.
 Bilateral/Plurilateral Pacts: Standalone appeal-arbitration deals or dispute clauses in newer trade agreements. Pros: tailored, faster to negotiate. Cons: fragments the system into overlapping "mini-WTOs" with patchy coverage.
 Unilateral Measures and Negotiated Settlements: With no enforceable ruling available, members impose tariffs unilaterally or strike direct bilateral deals (as in several 2025 US tariff agreements with partners like Japan, the UK, and Indonesia). Pros: faster results for the stronger party. Cons: replaces rules-based adjudication with power politics, disadvantaging smaller economies.
 Outlook Paralysis hasn't stopped WTO panels from ruling, but it removed the system's final binding check, turning many judgments into recommendations a determined loser can ignore. The MPIA proves binding review survives among willing members, but full restoration needs Appellate Body reform &mdash; narrower mandates, enforced deadlines, limits on precedent &mdash; changes the US has sought for years without resolution. Expect a fragmented, multi-speed landscape &mdash; arbitration for the willing, unilateral leverage for the rest &mdash; to persist for now.
