Who Owns What AI Writes for You
Copyright law varies by country and is actively changing. This post is written to be principle-led and jurisdiction-neutral, with no case names or dated rulings, so it should age reasonably. It still needs a review by someone qualified in your primary market, It is not legal advice and says so.
Someone on your team generated a campaign concept with AI. It is good. Marketing wants to build the quarter around it.
Two questions follow, and most organisations have not thought about either until the moment they need the answer.
Can a competitor use the same thing? And did you infringe anything getting here?
The first question: can you protect it The general principle in most places is that copyright protects human creative authorship. That framing is old and predates any of this, but it is the hinge the entire question turns on.
Where a work was produced purely by a system, with a person supplying only a short instruction, the case for protection is weak in many jurisdictions. There is an argument that the human contribution was not creative authorship but a request.
Where a person shaped the work substantially, selecting, arranging, editing, rewriting, combining outputs with their own material, the position is considerably stronger, because there is identifiable human creative contribution to point at.
There is no clean threshold, no word count, no percentage. It is a judgment about whether a person meaningfully authored the result.
And it varies by country. Some jurisdictions have provisions addressing computer-generated works specifically. Others do not. If you operate across markets, you may hold different positions on the same asset in different places.
The practical consequence is simple: the more meaningfully you shape and edit the output, the stronger your standing. This is not a legal technicality to game. It is a description of what actually happened, and it is the reason to treat AI output as a draft you are writing rather than a finished piece you received.
The second question: does it infringe Separate issue, separate risk, and the one that tends to get less attention.
These models learned from vast quantities of existing work. They do not store and reproduce that material in the ordinary sense, but they can produce output that closely resembles something specific, particularly when prompted toward a distinctive style, a well-known work, or a recognisable character.
The risk is low for ordinary business writing. A policy summary or a project update is not going to accidentally reproduce someone's protected work.
The risk rises sharply when you prompt toward a specific creator or property. Asking for something "in the style of" a named living artist, writer or designer is the clearest way to generate a problem, and it is a common request.
Rule of thumb: if a person produced this by hand and you would worry about it, the fact that a model produced it does not help you.
What your tool's terms say Distinct from copyright and often confused with it.
Whether copyright subsists is a legal question. What your vendor permits is a contractual one, and they are independent. A tool can grant you broad rights to use output in a work that is not protectable by copyright at all.
Read the terms for three things: what rights you have to commercial use, whether the vendor claims anything in your output, and whether they offer any indemnity if a third party makes a claim. Some enterprise agreements do offer indemnity. Consumer tiers generally do not, and defaults frequently differ between tiers of the same product.
What to do Treat it as a draft you are writing. Shape it substantially. Edit, restructure, add your own material, combine and select. This improves your position and, separately, produces better work.

<li>Do not prompt toward specific living creators or protected properties. The request itself is the risk.</li>
<li>Do not paste in third-party material you are not licensed to share. A client's confidential document, licensed research, a competitor's leaked deck. Putting it into a tool is a disclosure, and the tool's terms may permit uses you have not considered.</li>
<li>Check for close resemblance on anything that matters commercially. Search distinctive phrases. Reverse-image-search generated images. This takes minutes and catches the obvious cases.</li>
<li>Route commercially important work through your normal review process. AI involvement does not create an exception. If a campaign concept would have gone to legal before, it still does.</li>
<li>Keep a record of the human contribution. For anything you may need to defend, having drafts, edits and decisions documented is far better than reconstructing it afterwards.</li>

The question people actually ask Does any of this really matter for routine work?
For most of it, no. Internal documents, meeting notes, first drafts of ordinary business writing: the practical risk is negligible and treating it otherwise wastes everyone's time.
It matters for a specific set: anything you intend to protect and enforce, anything published commercially at scale, anything in a visual or creative field where style resemblance is a live issue, and anything where a client contract makes representations about originality.
Know which of your work falls in that set. Handle the rest normally.
What is actually settled Not much, and anyone telling you otherwise is overselling their certainty.
What is reasonably stable: human creative contribution strengthens your position, prompting toward specific protected works creates risk, and vendor terms are a separate question from copyright.
What is genuinely unsettled: how much human contribution is enough, how training on copyrighted material will ultimately be treated, and how different jurisdictions will converge or diverge.
Build your practices around the stable parts. Watch the unsettled parts, and do not build anything load-bearing on a position that a court has not yet taken.

Assume Anything You Paste In Could Be Read by Someone Else
 Adopt one default and most AI privacy incidents stop happening.
Assume anything you paste into a tool could be stored, reviewed by a human, used to improve the service, or surfaced in a breach.
Sometimes that assumption will be stricter than the reality. That costs you very little. The reverse assumption, made once, on the wrong document, costs a great deal.
Why the assumption is reasonable Vendor practices differ widely and change without much fanfare.
Many services retain conversation history by default. Many use inputs to improve their models unless you are on a tier or setting that excludes it, and those defaults commonly differ between free and paid versions of the same product. Many have human review processes for safety and quality, which means a person may read what you wrote.
None of this is sinister. It is ordinary software operation. But it means the mental model of "a private conversation with a computer" is wrong, and the interface actively encourages that wrong model. It looks like a chat window. It feels like typing to yourself.
What should not go in Specific and non-negotiable for any tool not explicitly cleared for it:
Customer personal data. Names with contact details, account numbers, health information, anything identifying a real person who did not agree to this.
Employee records. Performance notes, disciplinary matters, salary information, medical details, anything from an HR file.
Credentials. API keys, passwords, tokens, connection strings. These turn up in pasted logs and config files more often than anywhere else.
Unreleased financials. Results before announcement, forecasts, deal terms, anything with a disclosure obligation attached.
Third-party confidential material. A client's documents, licensed research, anything under an NDA. Your obligation to them does not pause because it was convenient.
Anonymise as a habit The practice that makes most of this manageable.
Replace real names with placeholders. Swap actual figures for representative ones of similar magnitude. Strip identifying details that are not needed for the task.
"Customer A, on the Enterprise plan, has raised eleven tickets this quarter about integration latency" preserves everything the model needs to draft a useful response. It contains nothing you would mind seeing outside the company.
Then put the real details back in yourself, afterwards. Thirty seconds of work, and you have removed the entire category of problem.
The habit part is what matters. Deciding case by case means eventually deciding wrong on a day when you are rushed. Anonymising by default means you do not have to get the judgment call right.
The question to ask When unsure, one test cuts through:
Would I be comfortable if this appeared outside the company?
Not "will it." Whether you would be comfortable if it did. If the honest answer is no, either anonymise it or use a tool your organisation has cleared for that level of sensitivity.
This test works because it bypasses the argument you would otherwise have with yourself about how likely a leak is. Probability is not the point. You are making a decision about exposure, and you should make it deliberately.
The organisational side For anyone setting policy rather than following it:
Approve specific tools for specific sensitivity levels, and say so plainly. "Use AI responsibly" is not a policy. "These two tools are approved for internal documents, this one is approved for customer data, nothing else is approved for anything" is.
Make the approved path easy. People route around friction. If the cleared tool is slow to access, they will use the one in their browser, and you will not find out.
Ask before, not after. Someone checking whether a document can go into a tool is a good day. Someone disclosing that it already did is a worse one, and the gap between those two outcomes is almost entirely about whether asking feels safe.
The short version Assume it is not private. Anonymise by default. Use cleared tools for sensitive work. Ask before you paste, not after.
Four habits, and they cost almost nothing once they are automatic.

The Do and Don't Card
One page. Print it, pin it up, and you have covered most of what matters.
&nbsp; DO Anonymise before you paste anything in. Placeholders for names and figures. Put the real details back yourself, afterwards.
Verify every specific detail. Names, numbers, dates, citations, quotes. The reasoning usually holds. The details are where it breaks.
Take ownership of the output as your own work. If your name is on it, you wrote it. Whatever produced the first draft.
Keep people involved in decisions that affect people. Hiring, evaluations, lending, discipline. A human reviews the outcome, every time.
Ask when you are not sure. Before you paste, not after. Asking early is a normal question. Asking late is an incident report.
&nbsp; DON'T Never paste sensitive information into an unapproved tool. Customer data, employee records, credentials, unreleased financials.
Never send output you have not read. Every word, start to finish. Skimming is how a fabricated figure reaches a client.
Never cite a source you have not opened. Confirm it exists. Then confirm it says what the output claims. Two separate steps.
&nbsp; How to use this Keep it visible for a month. That is usually long enough for the habits to stop requiring thought.
Each line is short because it is a reminder, not an argument. The reasoning behind every one of them is in the longer posts in this channel, and any line that seems arbitrary is worth reading up on rather than following blindly.
Two of them tend to get quietly abandoned first: reading every word, and checking citations. Both get dropped under time pressure, which is exactly when errors are most likely to be in the document. If you can only hold onto two, hold onto those.
