Copyright in the AI Era: Why Borders Still Matter
When Borders Blur: Jurisdiction and Enforcement Artificial intelligence is inherently transnational. Training data is scraped from servers scattered across dozens of countries, models are trained on cloud infrastructure that can sit anywhere, and the resulting tools reach users worldwide within seconds of release. Copyright law, by contrast, remains stubbornly territorial: each country applies its own rules about what counts as infringement and where. The UK's landmark Getty Images v Stability AI case shows how disruptive this mismatch can be. Getty's claim centered on allegations that Stability AI infringed copyright by storing images on servers in the UK while training its Stable Diffusion model, and the court ultimately found that training conducted abroad does not guarantee immunity from UK liability, though it can materially change a company's legal exposure. Because evidence of where training actually happened is usually held only by the company being sued, courts on both sides of the Atlantic are struggling just to establish the basic facts before they can apply the law. Ongoing US litigation, including The New York Times v. OpenAI and Microsoft, has faced similar friction over what evidence must be produced and from where.
The Monetization Squeeze This jurisdictional patchwork weakens the leverage creators have traditionally relied on. A publisher, photographer, or musician who negotiates licensing terms &mdash; or wins an injunction &mdash; in one country cannot easily stop the same underlying model from being trained, hosted, or served to users from a jurisdiction with looser rules. A "no" in one market can effectively be routed around elsewhere. Meanwhile, AI-generated summaries and answers increasingly sit between publishers and their audiences, reducing the traffic and subscription revenue that content creators depend on, even when no single act of infringement can be pinned to a specific court's jurisdiction. The result is a structural imbalance: creators bear the cost of production locally, while the economic benefit of their work can be captured by systems trained and monetized somewhere else entirely, often beyond the practical reach of the courts where the harm is felt.
A Handful of Gatekeepers? This dynamic feeds a broader concern: that a small number of well-capitalized AI companies, often controlled or founded by a handful of extremely wealthy individuals, could come to dominate how information is generated, filtered, and distributed globally. Because only a few firms have the capital, compute, and legal resources to train frontier models and defend the resulting lawsuits, jurisdictional complexity arguably favors incumbents &mdash; smaller publishers and independent creators often cannot litigate across multiple countries simultaneously. Critics worry this could concentrate influence over news, scholarship, and creative culture in the hands of a few companies whose commercial incentives may not align with pluralism, accuracy, or fair compensation for the humans whose work trained their systems.
Open Questions of Principle and Ethics Beneath the jurisdictional and economic issues lie deeper, unresolved questions that courts and legislators have only begun to address. Is training a model on copyrighted work inherently "transformative," or does it functionally compete with and substitute for the original? US courts have split in early rulings, and the US Copyright Office itself concluded that some AI training uses are unlikely to qualify as fair use, while others may. Do creators deserve compensation simply because their work had value to a system, even if no identifiable copy appears in any output? What obligations, if any, do AI developers owe to disclose what they trained on, or to let creators opt out in advance rather than after the fact? These are not settled matters of black-letter law; they are live disputes over principle, currently being argued case by case, country by country, with genuinely reasonable positions on multiple sides.
Why Deeper Scrutiny Is Needed Because these questions touch fundamental issues of authorship, fair compensation, market power, and free expression, they deserve more than piecemeal resolution through scattered private lawsuits and inconsistent national rules. Judicial scrutiny matters because courts are where the facts of training, storage, and distribution actually get tested &mdash; as Getty Images v Stability AI showed, much of the law's application still turns on unresolved evidentiary questions. Parliamentary and congressional scrutiny matters because only legislatures can build coherent frameworks for licensing, transparency, and cross-border enforcement that litigation alone cannot deliver. Until governments coordinate more deliberately &mdash; through bodies like WIPO or through harmonized national reforms &mdash; creators, AI companies, and the public will continue to operate in a legal environment defined more by jurisdictional accident than by settled principle.

Global Finance

AI Begins to Reshape Who Gets Hired in South Asia
The Hiring Gap Widens A clear divide is opening up in South Asia's labour market: multinational corporations and firms embedded in global value chains are pulling back on hiring far more sharply than domestic companies. The World Bank's World Development Report 2026 found that online job postings across South Asia fell by 1.6 per cent following the release of ChatGPT in late 2022, even as demand for AI-related skills increased, with the decline more pronounced among multinationals and globally linked firms than among local businesses. The pattern is most visible in India, where information technology services, business process management and a fast-growing network of global capability centres sit at the heart of multinational supply chains. Fresher hiring at some of the country's largest technology firms has dropped to multi-year lows, with entry-level openings down sharply year-on-year even as overall employment in the economy keeps expanding.
Why GenAI Is Rewriting the Hiring Calculus The slowdown is not simply cyclical. Generative AI tools now handle coding, drafting, data processing and first-line customer queries well enough that many companies are re-examining how many people a given task actually requires. Multinationals, with greater capital to invest in AI tools and the flexibility to shift work across borders, are adopting these efficiencies faster than domestic firms, which have generally been slower and more cautious in deploying the technology. The result is not mass layoffs so much as restrained hiring: fewer graduate intakes, roles redesigned around AI-assisted workflows, and executives openly signalling that future growth will come from productivity gains rather than headcount additions. At a recent industry summit, global pharmaceutical and technology firms operating in India described their India operations as expanding in scope while staying deliberately conservative on new hiring, precisely because AI is expected to absorb a growing share of routine work.
Call Centres Contract, AI and Governance Roles Expand The impact is uneven across job types. Routine, rules-based work is under the most pressure: customer support, data entry, back-office processing and entry-level coding and analyst roles, the traditional entry points for South Asia's business process outsourcing and IT services industries. In Pakistan, major outsourcing employers and freelance platforms have seen sharp declines as clients increasingly turn to AI tools instead of hiring for design, writing and coding tasks, a pattern echoed in Bangladesh's freelance economy and in Sri Lanka's clerical and banking-support roles. At the same time, demand is rising for a narrower set of specialised functions: AI engineering, data science, cloud and cybersecurity, AI governance and risk, and product roles that combine technical fluency with business judgment. Global capability centres, in particular, have kept adding jobs even as broader tech hiring has cooled, reflecting multinationals' appetite for higher-value, specialised work even as they scale back generalist recruitment.
Wages, Skills and the Policy Response For workers, the shift raises real risks. A joint ILO&ndash;World Bank analysis found that clerical and administrative jobs, which have historically offered a pathway to decent work for women and young workers in lower-income countries, are among those most exposed to automation, while many workers in roles that could benefit from AI's productivity gains still lack reliable internet access to take advantage of it. Economists at Davos this year underscored the stakes for the region directly. The IMF's Gita Gopinath told delegates that business process outsourcing would be affected by AI, with coders and call centres bearing the brunt, and warned that if services in India become more capital-intensive, generating enough jobs will become harder. Wage pressure is already visible in some segments, where growing competition for scarce entry-level roles is pushing pay down even as salaries rise sharply for AI-skilled specialists. Governments and industry bodies across the region have responded with reskilling pushes, from national AI training programmes in Pakistan to sector-wide upskilling initiatives in India, but the pace of these efforts still lags the speed at which entry-level roles are being automated or redesigned.
A Narrowing Window The World Bank's broader message is one of cautious opportunity rather than alarm: multinational firms may find it easier to automate tasks or relocate work across borders, while domestic firms have so far been slower to adopt AI, meaning the immediate employment effects are showing up first among internationally connected firms rather than the wider economy. That gives South Asia's governments, universities and employers a window, but a narrowing one, to redesign training pipelines around AI-complementary skills before the entry-level jobs that have long served as the region's route into the middle class shrink further. How quickly domestic firms follow multinationals in adopting AI, and how deliberately policymakers manage the transition, will determine whether the technology becomes a net job creator or a quiet closing-off of opportunity for the region's youngest workers.

Apple and Alibaba: A Landmark AI Partnership for China
The Reported Deal On August 14, 2026, Reuters reported that Apple has trained its own large language model built specifically for the Chinese market, a shift from its earlier approach of leaning on Chinese partners' models to power AI features there, since Western tools like ChatGPT and Claude are unavailable in China. The model was developed in partnership with Alibaba Group and trained with the Chinese firm's support, according to people who spoke on condition of anonymity because the information was sensitive. Alongside this proprietary model, Alibaba's Qwen model will handle text and image generation within Apple Intelligence across iOS, iPadOS, macOS and visionOS for Chinese users, while Baidu's technology is expected to support search-related functions, forming what Reuters sources called a "dual-track" system. Alibaba chairman Joe Tsai first confirmed the collaboration's intent in February 2025, and Apple reportedly evaluated Baidu, Tencent, ByteDance and DeepSeek before settling on Alibaba.
Why a Local Partner Was Necessary China requires every publicly offered generative AI service to be registered and pass a content-compliance review before release. Apple's generative AI service was registered by the Cyberspace Administration of China (CAC) in July 2026, roughly 22 months after Apple Intelligence launched elsewhere, reflecting how carefully Beijing vets foreign technology. Data localization and content-filtering rules make it difficult for a foreign company to deploy a model without domestic involvement, which explains why Apple paired its own model with Qwen and Baidu rather than launching independently.
Important Caveat: The claim that this makes Apple "the first foreign company approved by Beijing to offer a proprietary AI model in China" comes from Reuters' anonymous sourcing and has been repeated by multiple outlets, but Apple's registered entity, Apple Technology Development (Shanghai) Co., Ltd., is reportedly the first foreign proprietary-model listing on the CAC registry. Neither Apple nor Alibaba has publicly confirmed the technical details on the record, and exactly how queries are routed between Apple's model, Qwen, and Baidu remains undisclosed. This should be treated as strong reporting, not an official statement.
Consequences: Apple's China Strategy and Alibaba's Standing For Apple, this could be a meaningful lever against slipping smartphone share: the model aims to help Apple compete against Huawei and other local rivals that have gained ground with AI-equipped smartphones, with rollout potentially timed to new iPhone launches. Analysts have been cautiously bullish &mdash; Morgan Stanley called a confirmed partnership "a critical catalyst for Apple's competitive standing in China," while noting Alibaba's data reach could enable more personalized features. For Alibaba, the deal is a validation of its AI stack: it's a major win in China's competitive AI market, which also includes DeepSeek, and shares have moved notably on partnership news. Longer term, an Apple endorsement could boost Qwen's credibility for enterprise and international customers, positioning Alibaba Cloud as a serious rival to Baidu and ByteDance beyond China's borders.
Geopolitics, Privacy, and Cross-Border Constraints The arrangement lands amid a widening trade and diplomatic rift between the US and China over AI, making it a rare instance of deep US-China tech collaboration rather than decoupling &mdash; and one likely to draw scrutiny in Washington, as earlier reporting on the talks already triggered congressional attention. On privacy, Alibaba is reportedly barred from using data submitted through the Apple integration to train or improve its own models, a safeguard aimed at reassuring users, though independent verification of that boundary isn't possible from outside the companies. Open questions &mdash; how content moderation shapes model outputs, what data crosses between Apple's servers and Alibaba's cloud, and whether US regulators impose new restrictions &mdash; will determine whether user trust holds up once the feature actually ships.
Competitive Responses Domestically, Huawei has moved faster to integrate advanced AI into handsets while Apple's assistant sat in regulatory limbo, and Baidu, Tencent, and ByteDance &mdash; all evaluated and passed over by Apple &mdash; may now double down on their own device partnerships to defend share. Globally, rivals like Samsung (paired with Google's Gemini) will watch closely, since a workable Apple-Alibaba model could become a template for other Western firms seeking China market access, though Beijing's approval remains selective and case-by-case rather than a guaranteed path.
On balance, this deal is a pragmatic trade: near-term competitiveness and revenue potential for Apple and prestige for Alibaba, set against real uncertainty over data governance, regulatory dependency, and how the partnership survives further geopolitical friction.

Apple's Anti-AI Position Becomes Stock-Market Baggage
What "Anti-AI" Means for Apple Unlike Microsoft, Amazon, Alphabet and Meta, which are collectively projected to pour around $650 billion combined into 2026 capital expenditures, Apple has kept its own spending a fraction of that, planning roughly $14 billion in 2026 capex while relying on partners such as Alphabet's Gemini model rather than building proprietary AI infrastructure. That restraint, paired with a large cash pile and steady buybacks, earned Apple a reputation on Wall Street as a relative outsider to the generative-AI spending race &mdash; an "anti-AI" stock in market shorthand, even though the company still ships AI features across its devices.
From Safe Haven to Underperformer For much of the first half of 2026, that positioning worked in Apple's favor. As investors grew skeptical that heavy AI infrastructure spending by rivals would deliver adequate returns, Apple's capital-light approach appealed to traders and helped push the stock to a record high in late July. That dynamic has since reversed: since the July 28 peak, Apple shares have declined roughly 10%, pressured by disappointing earnings, while strong results from Microsoft, Amazon and Alphabet eased fears about AI overspending and pulled investors back into chipmakers and other AI beneficiaries. Over a recent stretch, Apple ranked among the worst-performing stocks in the S&amp;P 500 even as the Nasdaq 100 climbed &mdash; the mirror image of July, when Apple rallied while the broader tech index fell.
How Investors Are Reading the Reversal The shift shows up starkly in correlation data: Apple's 40-day correlation with the S&amp;P 500 has approached zero, one of the lowest readings in years, while its correlation with the Philadelphia Semiconductor Index has turned negative, meaning the stock has often moved opposite chip shares. That detachment cuts both ways &mdash; it cushioned Apple when AI-spending anxiety dominated, but it also means the stock isn't capturing the upside now that confidence in AI monetization has returned. Compounding the pressure, surging memory-chip demand from data centers has driven up component costs, raising concerns about margin pressure or higher iPhone prices ahead of an expected foldable model. Some analysts have responded accordingly: Jefferies cut Apple to underperform over pricing risk, and six of the 58 analysts tracked by Bloomberg who cover the stock now recommend selling &mdash; the most in nearly two years. With shares trading at a premium multiple, there is little room for the company to disappoint further.
A Balanced Picture, Not a Verdict The bull case hasn't disappeared. Portfolio managers note that Apple's balance sheet, ecosystem and buyback capacity remain among the strongest in the market, and if AI-spending fears resurface, its lack of correlation to that trade could again limit downside. On the other side, Apple's revenue is expected to expand about 15% this fiscal year &mdash; its fastest pace since 2021, though still below growth expectations for the broader S&amp;P 500 tech sector. In other words, the same qualities that made Apple a defensive "AI skeptic" play are now the reason it isn't sharing in the rally when sentiment swings the other way &mdash; a reminder that being out of step with a hot trade is a double-edged position, not a permanent hedge.
Outlook Apple's next tests arrive alongside a leadership transition, John Ternus succeeding Tim Cook as CEO, plus the rollout of a revamped Siri and a widely anticipated foldable iPhone. Whether Apple's cautious AI stance is validated as prudent or exposed as a lag will likely hinge on how convincingly those products land &mdash; and on whether the broader market's appetite for AI infrastructure spending keeps swinging as sharply as it has in 2026.

How the AI Borrowing Binge Is Pushing Up U.S. Treasury Yields
What's Actually Happening Since 2025, the handful of companies building the physical backbone of AI, mainly Amazon, Alphabet, Meta, Microsoft, and Oracle (often called "hyperscalers"), have shifted from funding data centers mostly out of cash to funding them with debt. Bond sales by this group roughly doubled between 2025 and the first half of 2026, and Wall Street estimates put total AI-linked debt issuance across the wider tech ecosystem somewhere between $300 billion and $570 billion for 2026 alone. That's the "AI borrowing binge." The harder question is how a wave of corporate borrowing to build data centers ends up moving the yield on a completely different instrument, the U.S. Treasury bond.
Treasury yields are set by supply and demand in the world's largest bond market, but they respond to more than Treasury issuance alone. A few distinct mechanisms link private AI borrowing to public borrowing costs, and they don't all pull with the same strength.
Competing for the Same Pool of Money The most direct channel is what economists call "duration supply." Data centers last for decades, so the companies financing them lean toward long-maturity bonds, 10-year, 30-year, even a rare 100-year note. Every dollar of that long-dated corporate debt is a dollar that might otherwise have bought a long-dated Treasury instead. Research from the Federal Reserve Bank of Dallas found that AI-related investment-grade issuance could add hundreds of billions of dollars of 10-year-equivalent duration risk to the bond market, on top of what the Treasury itself sells to fund the deficit. When investors have more high-quality, long-dated paper to pick from, they can demand a bit more yield across the board, Treasuries included, to lock up money for that long. Bank of America economists have estimated this "crowding out" effect added roughly 0.3 percentage points to the 10-year Treasury yield this year.
What Faster Growth Means for Fed Policy AI capital spending has become a real driver of measured GDP growth, and that changes how bond investors read the Federal Reserve. If AI investment keeps the economy running hotter than expected, the case for near-term rate cuts weakens, and markets price in a higher expected path for short-term rates over a bond's life. Since long-term yields are, in part, a weighted average of expected future short rates, stronger growth expectations tied to the AI buildout show up directly in the 10-year yield. There's an inflation angle too. IMF economists have flagged that AI-driven wealth effects, along with the heavy electricity demand from data centers, could add to price pressure, which pushes inflation expectations, and therefore nominal yields, higher still.
Term Premium, Fiscal Strain, and Risk Appetite Treasury yields split into two pieces: the path investors expect for short-term rates, and the "term premium," the extra compensation demanded for the risk of holding a long-term bond instead of rolling over short-term ones, as modeled by the New York Fed's ACM framework. That premium spent years near zero or negative and has turned solidly positive again. AI debt is one of several forces pushing it up. A bigger supply of competing long-dated paper raises uncertainty about who absorbs future issuance, and that uncertainty compounds a federal deficit running near $2 trillion a year against a national debt that just crossed $40 trillion. When investors watch two large borrowers, Washington and Silicon Valley, lean into the long end of the curve at the same time, they tend to price in extra compensation for the risk that supply outruns demand at any given yield.
Correlation, Causation, and What Else Belongs in the Picture None of this makes AI borrowing the main story. Reuters and the Globe and Mail have both noted that technology issuance is still a modest slice, roughly 13 percent, of total U.S. corporate bond supply, well behind financial firms. Yields have climbed in Japan, the UK, and across Europe too, where hyperscaler debt plays almost no role, which points to shared global forces: inflation stuck above target, uncertainty around a new Fed chair's approach, and worsening fiscal positions in many countries at once. Morningstar and Vanguard analysts describe the AI capex boom as reinforcing an existing move in yields rather than single-handedly causing it. The timing overlap between the debt wave and higher yields is suggestive, not proof. Isolating the AI-specific effect means comparing yield behavior across countries and against corporate-spread data directly, which is roughly what Dallas Fed researchers and bank economists have tried to do. Their read is that AI borrowing is a real, measurable, incremental contributor, worth something like tens of basis points, sitting on top of older and larger drivers: deficits, inflation risk, and uncertainty about central bank policy.

Meta's Muse Tops the Charts. Its Appetite for Personal Data Deserves a Closer Look
An agent built to act Muse isn't a chatbot in the usual sense. It debuted in early September and is designed to access a person's apps across categories like email, calendar, payments, health, shopping and the smart home. Users tell it what they need, and it takes action using the Muse Spark model that Meta built for real-world agentic work. That promise of handing off the busywork explains the buzz. It's also why the privacy questions are bigger than usual.
Number one on the App Store The download claim checks out. Muse overtook ChatGPT as the leading iOS free app in the U.S. and logged over 2.5 million downloads since its debut, according to Sensor Tower. One caveat: rankings varied by tracker, and some placed it fourth or fifth overall.
An 11% stock jump, with help The stock move is confirmed too. Meta gained 11.3% to close at $741.25 on Monday, adding roughly $192 billion to its market cap. Muse wasn't the only catalyst, though. The same day, Wells Fargo raised its price target to $796 from $640, citing early demand for Muse. So "contributed" is fair. "Caused" would overstate it.
Why critics see a privacy problem Futurism put it bluntly: many who tried Muse were unsettled by how much it dug up on them and how closely it monitored their habits. Processing happens in the cloud, on Meta's servers. Muse runs in a cloud virtual machine where it keeps what you share, with backups. That setup still lets Meta access VM data when needed to operate, support or secure the service, and conversations, tool calls and agent handoffs can be sanitized and used for training by default unless users switch it off. Permissions matter as well. One tester reported that Muse used Mac notification content without clear disclosure.
Cross-app reach and personalization at scale Meta's biggest advantage is also the core worry. Scott Galloway noted that Muse draws on a person's existing history with Instagram, Facebook and WhatsApp. Deletion has limits: after you delete something, Muse may still remember what it learned from it. Money flows add pressure, since Zuckerberg says Muse will take a small fee from transactions. And Amazon has blocked Muse from its shopping site, citing privacy and security risks. Multiply a single user's exposure by millions, and any flaw in these systems scales fast.
What reduces the risk Meta has built real safeguards. It says Muse doesn't share conversations or VM data with its ad systems, and credentials sit in a secure store so the AI model never sees your password. A planned Confidential VM is designed to keep data private even from Meta. Still, these are product policies rather than cryptographic guarantees until that version ships.
What to watch Users should connect only the accounts a task needs, turn off training in settings, and review what Muse remembers. Regulators should push for independent audits of the Confidential VM, clear retention timelines, proof that "sanitized" training data is truly de-identified, and plain disclosure of background data collection. Wall Street sees the same tension. Bank of America analysts wrote that privacy and trust remain key considerations for broader adoption.

Starlink Mobile: How SpaceX Plans to Connect Phones Almost Everywhere
Starlink's Plan to Put a Cell Tower in Orbit, and Signal Inside Your Home SpaceX built Starlink to sell broadband through a dish on the roof. That constellation is now huge, with more than 11,000 active satellites. Elon Musk wants it to become something bigger: a phone network that works on a remote highway and inside a building alike.
How satellite-to-cell works The idea is easy to picture. A satellite carries radio gear that behaves like a cell tower, and your phone treats it like a roaming partner. Today's service is built to connect with phones on the ground when there's a clear view of the sky. Traffic then moves across the constellation over optical laser links between satellites before reaching the ground.
Indoors is the hard part. Satellites are hundreds of kilometres up, signals are weak, and roofs and walls absorb them. So the indoor plan leans on the ground. Musk has said SpaceX could deploy many small stations that are essentially Starlink dishes also broadcasting in mobile bands, sitting on the roofs of homes and businesses. Satellites cover open areas, rooftop nodes push signal indoors, and the phone moves between them. How many nodes, who hosts them, and how they're paid for are still unclear.
What "approval" means Every country licenses its own airwaves, and no operator can transmit without permission. In the US, the FCC approved SpaceX's purchase of about 65 MHz of AWS-3, AWS-4 and H-Block spectrum from EchoStar, with waivers allowing terrestrial, satellite and hybrid use, tied to aggressive buildout obligations. Separately, the FCC approved 15,000 next-generation Starlink Mobile satellites in an order released October 6, 2026. A US licence doesn't carry over, though. Each market needs its own authorization.
Concerns for governments Regulators tend to weigh a few issues, and reasonable people disagree on how serious each one is.
<ul>
<li>Sovereignty: a foreign company's network covering national territory, with traffic routed through space.</li>
<li>Lawful intercept: police and courts expect access under local law, which may require local gateways.</li>
<li>Emergency services: calls must reach the right local responders with accurate location.</li>
<li>Interference: satellite signals can spill into neighbouring countries' bands.</li>
</ul>
Security and dependence: relying on one private operator that could, in principle, restrict service. These concerns often lead to conditions such as local data handling or partnering with domestic carriers.
The infrastructure behind it In space, it needs large satellites with powerful antennas and laser links. On the ground, it needs gateways linking to the internet and phone networks, a core network to handle calls and billing, and rooftop or tower nodes for indoor coverage. Spectrum comes from SpaceX's own licences and partner carriers. Phones matter too. Musk has said phones able to use the new spectrum will probably ship in around two years, after chipset changes.
Why Starship matters Bigger satellites need a bigger rocket. On September 28, Starship reached orbit for the first time and deployed 26 high-capacity V3 Starlink satellites, though the flight was cut short after an engine issue. Low-orbit satellites wear out and need replacing, so launch rate effectively sets network capacity. A reliable, reusable Starship is what could take Starlink from a US service to something closer to a global carrier. If Starship slips, the timeline slips with it.
Benefits and limits The upside is real: fewer dead zones, backup after disasters, and service for rural areas where towers don't pay off. Still, sceptics remain. A Nokia executive argued at MWC 2026 that satellite links can't replace terrestrial networks because of indoor coverage and limited satellite capacity. Building ground nodes costs money, foreign approvals are uncertain, and heavy reliance on one company is its own risk. The plan is ambitious and partly approved. It isn't yet proven.
